2017 Lawsuit Over College Station Retail Store at the Edge of Southside Historic District Dismissed

Controversial Lawsuit Facing College Station Retail Store Ends

A notable lawsuit, filed against a retail store located on the edge of the Southside Historic District in College Station has finally seen its conclusion. The case, originating in 2017, had been initiated by Fred and Shirley Dupriest, local residents living just three blocks away from the store. The couple had argued that the deed restrictions from 1927 did not permit the construction of the store. However, on March 4th, the lawsuit was voluntarily dismissed following a settlement.

The Retail Store at the Center of the Controversy

While pending approval by the College Station city council for rezoning, a new retail site, the Aggieland Outfitters store, had found itself in the heart of a legal dispute. The contention arose from conditions stated in an ancient deed dating back to 1927, overuse of space in the Southside historic district. The local inhabitants, the Dupriests, held that a store could not be built, based on these deed restrictions.

The ‘Compromise’ That Ended The Dispute

Following the lawsuit’s inception, many wondered what the final outcome would be. After an undisclosed “compromise,” the plaintiffs decided to dismiss the lawsuit, offering some relief to the operators of the Aggieland Outfitters store. The nature of this agreement remains confidential, though sources did reveal that Aggieland Outfitters will donate $25,000 dollars as part of the settlement to the Southside district.

This generous contribution not only ensures the continuity of the store’s operations, but it might also help to maintain the historic character of the neighborhood. Notably, there is no information about the settlement on the Aggieland Outfitters’ website or social media, despite widespread interest in this lawsuit.

A Final Verdict And New Future For The District

While lengthy, the lawsuit concluded with an unexpected turn of events. The once contested retail store can now continue its operations without any legal hindrances. Also, according to court records, the lawsuit cannot be refiled, providing a degree of certainty for the future of the Aggieland Outfitters store.

For now, the residents of the Southside Historic neighborhood can breathe easy, knowing that the district’s historical integrity will be preserved. The donation from Aggieland Outfitters as part of the settlement further contributes to this preservation. The College Station retail store and Southside Historic District now look forward to a future marked by greater harmony and mutual respect.
